Welcome to The Gym Market ("The Gym Market", "we", "our", or "us").

These Terms and Conditions govern your use of The Gym Market website, marketplace platform, and related services (the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms and Conditions.

If you do not agree with these Terms, you must not use the Platform.

1. ABOUT THE GYM MARKET

The Gym Market acts as a marketplace platform that facilitates connections between buyers and sellers and, where available, provides an integrated payment service through a third-party payment provider.

The Gym Market:

  • Is not the buyer or seller of any item listed on the Platform.
  • Does not take ownership of listed items.
  • Does not manufacture listed items.
  • Does not routinely inspect, test, verify or certify listed equipment.
  • Does not store, transport or deliver listed items.
  • Does not guarantee the accuracy of listings.
  • Does not guarantee the condition, safety, authenticity or suitability of listed items.
  • Is not generally a party to the underlying contract for the sale of an item between a buyer and seller.

The seller remains responsible for the item they list and sell.

The buyer and seller may choose to complete a transaction either:

  1. through The Gym Market's integrated payment functionality; or
  2. directly between themselves using an alternative payment method.

Different protections apply depending on how the transaction is completed, as set out in these Terms and our Buyer Protection Policy.

2. ELIGIBILITY

You must be at least 18 years old to use the Platform.

By using The Gym Market, you confirm that:

  • You have the legal capacity to enter into binding contracts.
  • All information you provide is accurate and up to date.
  • You will comply with these Terms and all applicable laws.

3. USER ACCOUNTS

Users may be required to create an account.

You are responsible for:

  • Maintaining the security of your account.
  • Keeping login credentials confidential.
  • All activity conducted through your account.

We reserve the right to suspend or terminate accounts at our discretion where we believe these Terms have been breached.

4. MARKETPLACE ROLE

The Gym Market provides a venue through which users may advertise, buy, and sell items.

We do not:

  • Verify ownership of items.
  • Verify the condition of items.
  • Verify user identities.
  • Guarantee completion of transactions.
  • Guarantee payment by buyers.
  • Guarantee delivery by sellers.

Users transact at their own risk.

5. SELLER RESPONSIBILITIES

When listing items on The Gym Market, sellers agree that:

5.1 Ownership

You must legally own the item being sold or have authority to sell it.

5.2 Accurate Listings

You must ensure listings are:

  • Truthful
  • Accurate
  • Not misleading

  • Up to date

You must accurately disclose:

  • Condition
  • Defects
  • Damage
  • Missing parts

  • Modifications

5.3 Prohibited Listings

Sellers must not list:

  • Stolen goods
  • Counterfeit productsIllegal items
  • Hazardous materials
  • Weapons
  • Controlled substances
  • Recalled products
  • Any item prohibited by applicable law

5.4 Pricing

Sellers are solely responsible for determining item prices.

5.5 Fulfillment

Sellers are responsible for:

  • Dispatching items as agreed
  • Packaging items appropriately
  • Providing accurate delivery information
  • Communicating with buyers

6. BUYER RESPONSIBILITIES

Buyers agree that they:

6.1 Review Listings Carefully

Buyers are responsible for reviewing:

  • Item descriptions
  • Images
  • Condition details
  • Seller information before purchasing.

6.2 Ask Questions

Buyers should raise any concerns with the seller before committing to a purchase.

6.3 Payment

Buyers must pay the agreed purchase price and any applicable fees.

6.4 Inspection

Where possible, buyers should inspect items upon receipt and notify sellers promptly of any issues.

7. PAYMENTS AND TRANSACTIONS

The Gym Market does not process payments and is not a payment provider.

The Platform provides a marketplace where buyers and sellers may communicate and arrange transactions directly with one another.

Buyers and sellers are solely responsible for agreeing:

  • Payment methods;
  • Payment timing;
  • Collection arrangements;
  • Delivery arrangements;
  • Refund arrangements;
  • Return arrangements;
  • Any other transaction terms.

The Gym Market does not:

  • Collect payments;
  • Hold funds;
  • Process payments;
  • Provide escrow services;
  • Guarantee payments;
  • Verify payment completion;
  • Facilitate refunds.

Any financial transaction entered into between users is undertaken entirely at their own risk.

The Gym Market accepts no responsibility for:

  • Non-payment;
  • Late payment;
  • Fraudulent payments;
  • Chargebacks;
  • Bank transfer disputes;
  • Cash transaction disputes;
  • Payment processor disputes.

Users should take appropriate precautions before completing transactions.


8. TRANSACTIONS BETWEEN USERS

All transactions arranged through The Gym Market are completed directly between buyers and sellers.

The Gym Market does not supervise, participate in, or control any transaction.

This includes transactions involving:

  • Cash payments;
  • Bank transfers;
  • Mobile payment services;
  • Local collections;
  • Courier arrangements;
  • Delivery arrangements.

Users are solely responsible for:

  • Verifying the identity of the other party;
  • Inspecting items before purchase where possible;
  • Ensuring payment has been received;
  • Arranging safe collection or delivery.

The Gym Market accepts no liability for:

  • Fraud;
  • Theft;
  • Non-payment;
  • Delivery failures;
  • Personal injury;
  • Property damage;
  • Misrepresentation;
  • Item condition disputes;
  • Any losses arising from transactions between users.

The Gym Market may, at its sole discretion, attempt to facilitate communication between users but is under no obligation to investigate or resolve disputes.

9. DISPUTES BETWEEN USERS

All disputes arising from transactions are the responsibility of the buyer and seller involved.

The Gym Market is not a party to any agreement formed between users.

Users should attempt to resolve disputes directly.

The Gym Market may, but is not required to:

  • Facilitate communication;
  • Request information;
  • Encourage resolution.

The Gym Market does not:

  • Determine legal ownership;
  • Determine liability;
  • Enforce agreements;
  • Issue refunds;
  • Recover payments.

Users acknowledge that any legal claims arising from transactions must be pursued directly against the relevant buyer or seller and not against The Gym Market.

10. LISTINGS AND CONTENT

Users remain solely responsible for content they submit to the Platform.

By uploading content, you warrant that:

  • You own the content or have permission to use it.
  • It does not infringe third-party rights.
  • It is not unlawful, defamatory, offensive, or misleading.

The Gym Market reserves the right to:

  • Edit listings
  • Remove listings
  • Remove images
  • Suspend accounts
  • Delete content

without prior notice.

11. NO RESPONSIBILITY FOR LISTINGS

The Gym Market does not create, own, endorse, verify, or control user listings.

We make no representations regarding:

  • Accuracy
  • Quality
  • Safety
  • Legality
  • Authenticity
  • Ownership

of any listed item.

Any reliance on listing information is entirely at the user's own risk.

12. PROHIBITED CONDUCT

Users must not:

  • Commit fraud
  • Misrepresent items
  • Circumvent payment systems
  • Harass other users
  • Upload malicious software
  • Interfere with Platform operations
  • Violate applicable laws

We may remove users who engage in prohibited conduct.

13. FEEDBACK AND REVIEWS

Users may leave reviews and feedback.

Reviews must:

  • Be truthful
  • Be based on genuine experience
  • Not contain abusive, defamatory, or misleading statements

The Gym Market may remove reviews at its discretion.

14. LIMITATION OF LIABILITY

To the fullest extent permitted by law, The Gym Market shall not be liable for:

  • Loss of profits
  • Loss of revenue
  • Loss of opportunity
  • Indirect damages
  • Consequential damages
  • Personal disputes between users

The Gym Market's total liability arising from use of the Platform shall not exceed the amount of fees paid by the user to The Gym Market during the previous 12 months.

Nothing in these Terms excludes liability where such exclusion would be unlawful.

15. INDEMNITY

Users agree to indemnify and hold harmless The Gym Market, its owners, directors, employees, and affiliates from any claim, loss, liability, damage, or expense arising from:

  • User conduct
  • User listings
  • Transactions
  • Breaches of these Terms
  • Violations of law

16. INTELLECTUAL PROPERTY

All Platform branding, logos, graphics, software, and content owned by The Gym Market remain our intellectual property.

Users may not copy, reproduce, distribute, or exploit Platform content without written permission.

17. TERMINATION

We may suspend or terminate access to the Platform at any time where:

  • These Terms are breached.
  • Fraud is suspected.
  • User activity presents legal or reputational risk.

18. CHANGES TO THESE TERMS

We reserve the right to update these Terms at any time.

Continued use of the Platform following changes constitutes acceptance of the revised Terms.

19. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
