PROHIBITED ITEMS POLICY

1. PURPOSE

This Policy identifies items that may not be listed, advertised, sold, exchanged or promoted on The Gym Market.

The Policy applies regardless of whether a transaction is completed through The Gym Market's integrated payment functionality or arranged directly between a buyer and seller.

The Gym Market reserves the right to remove any listing at its discretion, whether or not the item appears specifically on this list.

Where we believe an item, listing or transaction presents a safety, legal, fraud or reputational risk, we may remove the listing or restrict the relevant account without prior notice.

The fact that an item is available for purchase through The Gym Market does not mean that The Gym Market has inspected, tested, verified, certified or approved the item.


2. PROHIBITED ITEMS

The following categories of items are prohibited from being listed on The Gym Market.

2.1 Illegal Goods

The following are prohibited:

  • Stolen property;
  • Goods obtained unlawfully;
  • Counterfeit goods;
  • Fake or unauthorised branded products;
  • Goods that infringe intellectual property rights;
  • Items that cannot legally be sold or possessed;
  • Items subject to a legal restriction that prevents their sale.

Sellers must have the legal right and authority to sell any item they list.


2.2 Unsafe Fitness Equipment

The following are prohibited:

  • Equipment subject to a known safety recall;
  • Equipment with undisclosed structural damage;
  • Equipment that is materially unsafe for its intended use;
  • Equipment with significant safety-critical defects;
  • Equipment that has been deliberately modified in a way that compromises safety;
  • Equipment missing essential safety components where this makes the item unsafe;
  • Equipment that has been tampered with to conceal a defect.

Minor wear and tear or cosmetic damage is not necessarily prohibited, provided it is accurately disclosed in the listing and does not make the equipment unsafe.

Sellers remain responsible for accurately describing the condition of their equipment.


2.3 Medicines and Medical Products

The following are prohibited:

  • Prescription medicines;
  • Controlled substances;
  • Unlicensed medicines;
  • Medical devices requiring regulatory authorisation where the seller does not have the appropriate authority;
  • Medical products that cannot legally be sold by the seller;
  • Products making unlawful medical or health claims.

2.4 Supplements and Performance-Enhancing Products

The following are prohibited:

  • Anabolic steroids;
  • Performance-enhancing drugs;
  • Unlicensed supplements;
  • Weight-loss drugs or products where their sale is restricted;
  • Products containing prohibited or controlled substances;
  • Products falsely claiming to contain pharmaceutical or performance-enhancing ingredients;
  • Products making misleading or unlawful health claims.

2.5 Weapons and Weapons-Related Items

The following are prohibited:

  • Firearms;
  • Ammunition;
  • Explosives;
  • Prohibited knives;
  • Tasers and other prohibited electrical weapons;
  • Other weapons prohibited by applicable law;
  • Weapon components or accessories where their sale is legally restricted.

2.6 Tobacco, Nicotine and Alcohol

The following are prohibited:

  • Alcoholic beverages;
  • Tobacco products;
  • Cigarettes;
  • Cigars;
  • Vapes and vaping devices where prohibited;
  • Nicotine products;
  • Other age-restricted nicotine products.

2.7 Hazardous Materials

The following are prohibited:

  • Dangerous chemicals;
  • Fuels;
  • Explosive materials;
  • Corrosive substances;
  • Toxic substances;
  • Flammable materials;
  • Radioactive materials;
  • Other dangerous goods that cannot lawfully or safely be sold through the Platform.

Users must not list items that require specialist handling, storage or transportation where those requirements cannot be safely fulfilled.


2.8 Animals and Restricted Animal Products

The following are prohibited:

  • Live animals;
  • Endangered species;
  • Protected wildlife;
  • Animal products whose sale is prohibited or restricted by law;
  • Products obtained through illegal hunting or trafficking.

2.9 Adult and Pornographic Products

The following are prohibited:

  • Pornographic materials;
  • Explicit sexual content;
  • Sexually explicit products;
  • Adult sexual products;
  • Content involving the sexual exploitation of any person.

2.10 Services

The Gym Market is intended primarily for the sale of physical fitness and gym-related products.

The following are therefore prohibited unless expressly authorised by The Gym Market:

  • Personal training services;
  • Coaching services;
  • Fitness memberships;
  • Gym memberships;
  • Labour services;
  • Installation services;
  • Repair services;
  • Consultancy services;
  • Other services not specifically supported by the Platform.

The Gym Market may introduce approved service categories in the future.


2.11 Digital Goods

The following are prohibited unless expressly authorised by The Gym Market:

  • Software licences;
  • Digital subscriptions;
  • Downloadable products;
  • Digital accounts;
  • Digital-only memberships;
  • Activation codes;
  • Digital products that cannot be independently verified.

2.12 Financial Products and Payment Instruments

The following are prohibited:

  • Bank accounts;
  • Payment accounts;
  • Credit or debit cards;
  • Gift cards obtained unlawfully;
  • Cryptocurrency or financial products;
  • Loans or investment products;
  • Financial services;
  • Items intended to facilitate financial fraud.

2.13 Personal Data and Accounts

Users must not list or sell:

  • Personal data;
  • Identity documents;
  • Passports;
  • Driving licences;
  • Account credentials;
  • Social media accounts;
  • Email accounts;
  • Membership accounts;
  • Stolen or compromised login credentials.

2.14 Misleading or Fraudulent Listings

The following are prohibited:

  • Fake listings;
  • Listings for items that do not exist;
  • Listings using stolen photographs or descriptions;
  • Listings that intentionally conceal material defects;
  • Listings designed to obtain payment without supplying the advertised item;
  • Duplicate or misleading listings intended to manipulate buyers;
  • Listings containing false claims about an item's brand, condition, specifications or authenticity.

3. GYM EQUIPMENT-SPECIFIC REQUIREMENTS

Because The Gym Market specialises in fitness and gym equipment, sellers must take particular care when listing equipment that could present a physical safety risk.

Sellers should not list equipment where they know that:

  • A structural component is cracked or compromised;
  • A safety-critical mechanism does not function;
  • A weight-bearing component is materially damaged;
  • A cable, pulley, attachment or locking mechanism is unsafe;
  • Electrical components present a known safety risk;
  • The equipment has been subject to a recall and remains unsafe to use.

Equipment that has been repaired or refurbished may be listed where the seller accurately discloses the repair or refurbishment and the equipment is otherwise suitable for sale.

The Gym Market does not certify or approve repaired or refurbished equipment.


4. SELLER RESPONSIBILITY

Sellers are solely responsible for ensuring that their listings comply with:

  • This Policy;
  • The Gym Market's Terms & Conditions;
  • Applicable laws and regulations;
  • Any relevant manufacturer restrictions.

Listing an item on the Platform does not mean that the item has been approved, verified, tested or certified by The Gym Market.

Sellers must not attempt to circumvent this Policy by describing a prohibited item using alternative terminology or by listing it within an unrelated category.


5. BUYER RESPONSIBILITY

Buyers should review listings carefully and report any item that they believe may breach this Policy.

Buyers should not purchase an item where they suspect that it is:

  • Illegal;
  • Stolen;
  • Counterfeit;
  • Unsafe;
  • Recalled;
  • Fraudulently advertised.

Purchasing an item through The Gym Market does not constitute confirmation that the item has been independently verified or approved by The Gym Market.

Where a buyer has purchased an item through The Gym Market's integrated payment functionality and subsequently believes that the item breaches this Policy, they should contact The Gym Market Support Team as soon as possible.


6. ON-PLATFORM PAYMENTS AND PROHIBITED ITEMS

The availability of The Gym Market's integrated payment functionality does not mean that every listed item is eligible for purchase or that The Gym Market has verified the item.

If a prohibited or potentially unsafe item is identified after an on-platform purchase has been made, The Gym Market may:

  • Suspend the transaction;
  • Delay or suspend seller payout where permitted;
  • Remove the listing;
  • Investigate the seller's account;
  • Request additional information;
  • Take action under the Buyer Protection Policy;
  • Cancel the transaction where appropriate and permitted;
  • Report unlawful activity where required or appropriate.

The availability of Buyer Protection does not override this Policy or applicable law.


7. OFF-PLATFORM TRANSACTIONS

This Policy applies regardless of whether payment is made through The Gym Market or directly between the buyer and seller.

However, where a transaction is completed outside The Gym Market:

  • The Gym Market cannot control the payment;
  • The Gym Market cannot reverse or recover funds;
  • Buyer Protection does not apply;
  • The Gym Market cannot guarantee a refund.

Users may still report prohibited listings or activity to The Gym Market, even where they have arranged payment directly with another user.


8. ENFORCEMENT

The Gym Market may take action where we believe a listing or user breaches this Policy.

This may include:

  • Removing listings;
  • Rejecting listings;
  • Suspending transactions;
  • Delaying or suspending seller payouts where permitted;
  • Restricting accounts;
  • Suspending accounts;
  • Permanently banning users;
  • Removing associated content;
  • Reporting suspected unlawful activity to relevant authorities.

We may take action without prior notice where reasonably necessary to protect users, comply with the law or protect the Platform.


9. APPEALS

Where a listing or account has been restricted or removed, the user may contact The Gym Market Support Team to request further information or, where appropriate, appeal the decision.

The Gym Market may request additional evidence or information before reconsidering a decision.

Submitting an appeal does not guarantee that a listing will be reinstated or an account restriction removed.


10. POLICY CHANGES

The Gym Market may update this Policy from time to time to reflect changes in:

  • Applicable laws;
  • Platform services;
  • Marketplace risks;
  • Product categories;
  • Safety requirements.

The latest version will be published on the Platform.

In the event of any inconsistency between this Policy and the Terms & Conditions, the Terms & Conditions shall take precedence.
